TAKE NOTICE that Loyalist Township has initiated applications to the amend the Official Plan and Zoning By-law and that the Council of the Corporation of Loyalist Township has scheduled a hybrid Public Meeting on Tuesday, July 8, 2025, at 6:00 p.m. or shortly thereafter to consider amendments to the comprehensive Zoning By-law 2001-38, as amended and the Township Official Plan in accordance with the provisions of Sections 34(12) and 17(15) of the Planning Act, R.S.O. 1990.

The Public Meeting will be a hybrid meeting, where participants can attend the Council Chambers in person at 263 Main Street, Odessa or via the Zoom platform. Those attending through Zoom can find instructions on how to participate in the public meeting at the following link https://loyalist.civicweb.net/Portal/ prior to the meeting. The Zoom link can also be found on the Council Agenda prior to the meeting at the previous link. Location

The subject lands are comprised of lands within the Township that are in the urban serviced areas and where zoning permits single-detached, semi-detached and street front townhome dwellings. Additional policies and zone regulations apply to lands within the Township that are designated and zoned Rural, Hamlet and Prime Agricultural in the Official Plan and Zoning By-law. As the applications cover a large portion of the Township, a key map is not provided.

Additional Residential Units – Official Plan Amendment: D09-001-2025 & Zoning By-law Amendment:  D14-003-2025

Purpose and Effect of the Applications

The Township has initiated applications to amend the Official Plan and Zoning By-law as part of the Township’s Housing Accelerator Fund (HAF) Action Plan Initiative 8 to implement four units as-of-right zoning in all urban serviced areas. The proposed amendments will permit up to four (4) residential units on properties within the urban serviced areas where zoning permits single-detached, semi-detached or street front townhomes. This would include the principal dwelling unit and up to three additional residential units, one of which may be located in a detached accessory building on the same lot as the principal building. Associated zoning provisions are also being proposed including but not limited to maximum dwelling unit size, minimum setbacks and parking requirements.

The Official Plan Amendment also proposes amendments to existing permissions for an additional residential unit in the Rural, Prime Agricultural and Hamlet designations where a single detached dwelling is permitted. Revisions to policies are primarily being proposed to provide a clear differentiation between requirements for additional residential units that are located outside the urban serviced areas and to require the same minimum lot size as mandated in the existing zoning.

The Zoning By-law Amendment proposes to implement the Official Plan policies by including permissions for additional residential units in particular zones as well as to include applicable performance standards.

You are invited to attend this hybrid Public Meeting to express your views about these applications or to be represented by Counsel for this purpose. However, written comments submitted prior to the meeting are strongly encouraged.

REPRESENTATION AND INFORMATION

ANY PERSON may attend the hybrid Public Meeting and make a verbal statement and/or make written representation either in support of or opposition to the proposed official plan and zoning by-law amendment applications.

If a person or public body would otherwise have an ability to appeal the decision of Loyalist Township Council to the Ontario Land Tribunal, but the person or public body does not make oral submissions at the public meeting or make written submissions to Loyalist Township before the proposed official plan amendment is adopted or the by-law is passed, the person or public body is not entitled to appeal the decision to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to Loyalist Township before the approval authority gives or refuses to give approval before the proposed official plan amendment is adopted or the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Please note that only the Applicant, the Minister of Municipal Affairs and Housing, a specified person or public bodies as outlined in the Planning Act may appeal decisions in respect of applications for Official Plan and Zoning By-law to the Ontario Land Tribunal.
