Amherst Island Trailer Licensing By-law 2013-080

For the purpose of this by-law the following definitions shall apply:

“Council" shall mean the Council of The Corporation of Loyalist Township;

"Director” shall mean the Director of Administrative Services or designate for The Corporation of Loyalist Township;

"License Year" means the twelve month period commencing on January 1 and continuing to December 31;

"Medical Officer of Health" shall mean the Medical Officer of Health for Kingston Frontenac Lennox and Addington Public Health or a duly authorized agent;

"Municipality" shall mean The Corporation of Loyalist Township;

“Provincial Offences Officer” shall mean an individual appointed by by-law or other agencies designated by Council who are responsible for the administration of this by-law;

"Stored Trailer" means a trailer that is located on a property for the purpose of sale or storage, but shall not include any trailer used at any time while located on the property for living, sleeping or eating accommodations of persons;

"Trailer" means any vehicle so constructed that it is suitable for being attached to and propelled by a motor vehicle and capable of being used for the living, sleeping or eating accommodation of persons, notwithstanding that such vehicle is jacked up or that its running gear is removed and this shall apply to any vehicle self-propelled or towed or capable of being towed.  This definition does not include a mobile home where the structure has been placed on a foundation and has been connected to a potable water system and a sewage disposal system.

2.1 The Director or his or her designate is responsible for the administration of this by-law.

2.2 All Provincial Offences Officers with authority to enforce the by-laws of the Municipality are responsible for enforcing the provisions of this by-law.

3.1 No person shall locate a trailer in the Amherst Island Ward of Loyalist Township, except in a trailer park, for a period of thirty (30) days or longer in any year without a license issued by the Municipality, but tis does not apply to a stored trailer. 

3.2 The owner or lessee respectively of each trailer located in the said Ward, except in a trailer park, for thirty (30) days or longer in any year shall, not later than five days after the expiration of the said period of thirty (30) days, file with the Director an application for placement of a trailer and shall pay the fees outlined under this by-law and shall provide the information requested under this by-law and shall ensure that a civic address sign is provided for the property where the trailer will be located.

3.3 The information to be included with the application for placement of a trailer shall include, but shall not be limited to, the name and address of the applicant, civic address and legal description of the property, a description of the trailer to be located on the property, details of sewage approval for the site from the Medical Officer of Health and a plot plan showing the location of the trailer, location of any sewage facilities, wells and accessory structures including distances to property boundaries. 

3.4 The license fee shall be $50 for the first month and $20 per month for each additional  full or partial month within the license year that the trailer is used, but shall not include months when the trailer qualifies as a stored trailer. 

4.1 If a court of competent jurisdiction declares any provision, or part of a provision, of  this by-law to be invalid, or to be of no force and effect, it is the intention of Council in enacting this by-law that each and every provision of this by-law authorized by law be applied and enforced in accordance with its terms to the extent possible according to law.

5.1 Every person who contravenes any provisions of this by-law shall be guilty of   an offence and, upon conviction, is subject to a fine as provided in the Provincial Offences Act and to any other applicable penalties.

6.1 By-law 15-86 of the former Amherst Island Township and any other by-laws or portions thereof conflicting with this by-law are hereby repealed.

6.2 This by-law shall come into force and take effect on January 1, 2014.
