Building, Plumbing and Other Permits

Do I need a building permit?

You need a building permit if you are:

  • Building a stand-alone structure that measures 161 square feet (15 m2) or more
  • Adding or changing any heating or plumbing systems
  • Changing an existing structure
  • Adding to an existing structure
  • Building a deck
  • Installing a pool
  • Installing a hot tub
  • Installing a woodstove

To submit an application please visit our online permit portal, or submit your application in person. The Building Division is located at 18 Manitou Crescent West, Amherstview.

All projects require a deposit at the time of application, which is applied toward the permit fee. For new residential dwellings, the permit deposit is $500 per application. For other projects, the permit deposit is $100. You can pay the deposit in person at the Manitou Crescent office, as above, by means of cheque or Interac.

 Book an inspection

Once your permit has been issued, you or your contractor need to contact us for an inspection at various stages throughout the construction project. The inspection requirements will be listed on the back of your building permit.

Inspections are needed to make sure that the project is being built according to the plans, the manufacturer's specifications, and the Ontario Building Code. This ensures the safety and integrity of the structure for its intended use.

Addition or Renovation

An application for a renovation or addition permit requires substantial information in order to be processed.

If you are not designing your addition or renovation yourself, you may require the services of a qualified designer. Items that must be engineered will need to be certified by a licensed Professional Engineer.

All work on the drawings must conform to the standards set out in the Ontario Building Code, applicable municipal by-laws, and other applicable laws. We recommend that you contact a building inspector early in your design process. To meet with an inspector please call 613-386-7351, ext. 128# to make an appointment.


What do I need to apply?

Before we can issue a permit for you to add or renovate, we require the following:

  • A Completed building permit application or Submit online
  • Schedule 1: Designer information form
  • $100 deposit
  • Copy of deed/land transfer (copies may be obtained at Service Ontario)
  • Agent authorization form (required if the property owner is not submitting the application)
  • Approvals from other agencies as required
  • Site plan indicating the following, if exterior additions are proposed:
    • Property address
    • Dimensions and area of the property
    • Square footage of all existing structures on the property
    • Dimensions of any proposed additions
    • Distance from proposed addition to all property lines, easements, rights-of-way, and other structures
    • Location of septic system and distance from proposed addition if applicable
    • Location of water and sewer lines, if applicable
    • Site plans may be hand drawn but must be clear and drawn to scale
  • 2 sets of construction drawings (minimum 11” x 17” and PDF version) demonstrating the following information:
    • Foundation plan
    • Floor plan
    • Cross section
    • Elevations
  • Truss and floor joist layout from the manufacturer
  • Heat loss calculations and duct design
  • Energy efficiency design summary sheet
  • May require review of septic system.
  • Township entrance permit and damage deposit for construction projects with a value greater than $10,000

Deck

 A plan for a deck does not require the same detail as a house plan and can therefore be easily produced by a homeowner. If you do choose to draw up the plans for your deck there are several items which should be included so that we can process your application.

What do I need to apply?

In order for our building division to process your application for a deck permit, there are two drawings you must provide:

  • A site plan showing location of the deck and distances to lot lines and if applicable distance to the house
  • A plan for your deck

Your deck plan

A plan for a deck does not require the same detail as a house plan, so you can easily produce it yourself. If you do choose to draw up the plans for your deck there are several items which should be included so that we can process your application.

  • Material and sizes for joists, beams and posts; including spans
  • Height of deck above finished grade and railing height above finished grade
  • Material for pier supports
  • Dimensions of the completed deck including
    • Outside dimensions of the deck
    • ​Spacing between beams, joists and posts
  • Section of deck using sample drawings as guideline, should include:
    • Construction of railing including connection to deck
    • Beam connections detail
    • ​Height of deck and railing height
  • Detail showing connections between posts and pier supports and connections between beams and posts

If a deck is not designed by you, it will then have to be prepared by a qualified designer and a Form 1 (Designer Information) will have to be completed.

Farm Buildings & Structures

The construction of farm buildings and structures can vary substantially.

If the purpose of the structure is to house livestock or manure, you will likely need to supply proof of completion of a Nutrient Management strategy or plan from the Ministry of Agriculture and Food.

All buildings or structures to home livestock and manure storage must also meet the minimum distance separation formula calculation (MDSII). What do I need to apply?

Here's what we need to get from you in order to issue a building permit for a farm building or structure:

  • Completed application
  • Copy of deed and survey
  • Two complete sets of plans indicating the following:
    • Foundation plan
    • Building elevations
    • Cross section view indicating dimensions, heights and construction materials;
    • Site plan indicating the following:
      • Lot dimensions and area
      • Location of all existing farm building buildings relative to property lines
      • Location of proposed farm building relative to property lines, road, other structures, manure storage, tile drainage, dwelling on the same lot, septic system, wells, easement and/or rights of way and overhead power lines
      • Location of proposed farm building relative to any existing vacant residential lot and dwelling on nearby property within 500 meters
      • Dimensions and heights of proposed structure
      • Location of any watercourses, drainage, ditches, culverts and other water bodies including high water mark, top of bank and 1:100 year floodline contour (if available) with wave uprush limit
      • Address and street name
  • Health Unit approval (for rural areas); 613-354-3357
  • If building is to house livestock or store manure, indicate type of livestock, number of livestock and capacity of building, please supply proof of approval for Nutrient Management strategy or plan from the Ministry of Agriculture and Food.
  • If manure storage system; then indicate type:
    • Covered storage system
    • Open solid and runoff storage system
    • Open liquid tank and runoff system
    • Earthen liquid and runoff storage system
    • Other
  • Will require Professional Engineer to design farm building or structure when the proposed floor area exceeds 600 square meters
  • Cataraqui Region Conservation Authority approval (properties along or near water)
  • Ministry of Transportation Approval (properties that face provincial highways)
  • Engineering details or plans prepared by Professional Engineer must be stamped

Inspections

Garage or shed

 

If you're not designing your own garage, you will need a qualified designer. If your garage is designed as a floating slab larger than 50 m2, it must be designed by a licensed Professional Engineer.

All drawings must meet the Ontario Building Code, any municipal by-laws, and other applicable law.

We recommend that you contact our building division early in your design process. For an appointment with an inspector, please email the Development Analyst or call 613-386-7351, ext. 128#.

What do I need to apply?

Here's what we need to get from you in order to issue a building permit for a garage or carport:

  • Completed application form

  • Copy or deed and survey

  • Two complete sets of plans, one copy provided in paper and one copy provided in an electronic version 11” by 17” PDF format, indicating the following:Cataraqui Region Conservation Authority approval for properties near water

    • Foundation plan showing foundation type, dimensions, and structural
    • If structural slab is in excess of 50 m2(538 square feet), it must be stamped by a Professional Engineer qualified in structural design
    • Building elevations
    • Cross section view indicating dimensions, height and construction materials
    • Site plan indicating
      • Location of garage relative to all property lines, driveway, easements, rights-of-way, existing building, street lines
      • Location of any overhead power lines
      • Location of nearby streams, rivers, or lakes
      • For rural properties, location of well and septic system
  • Ministry of Transportation approval for properties that front on provincial highways

  • Entrance permit from the Loyalist Township Engineering division

  • Completed Form 1 (designer form)

Any prefabricated shed over 10m2 (108 square feet) requires engineered details and must be stamped by a Professional Engineer licensed in Ontario.We have prepared a Garages and Sheds permit package for you to download, if you wish.

Inspections

House

 

House permit applications require substantial information to be processed.

If you are not designing your own home, you will need the services of a qualified designer.

If you are not acting as the general contractor on your home, you will need to enroll the dwelling with Tarion (new home warranty).

All work on your drawings must conform to the standards set out in the Ontario Building Code, any applicable municipal by-laws, and other applicable laws.

What do I need to apply?

We provide a complete permit application package for your home.

New home application package

Before we can issue a permit to build your new home, we require the following:

  • Completed Application

  • Copy of Deed and Survey

  • Two complete sets of plans, one copy provided in paper and one copy provided in an electronic version 11" by 17" (PDF format) indicating the following:

    • Foundation plan

    • Floor plans including if basement is to be finished

    • Building elevations

    • Cross section view indicating dimensions, heights and construction materials

    • Truss layouts of both roof and floor (if engineered floor joists are to be used)

    • Site plan indicating the following:

      • Lot dimensions and lot area

      • Location of house (with measurements) relative to property lines, road, other structures, septic system, well, municipal and/or private easements and rights-of-way and overhead power lines

      • Location, width, and type of driveway and distance separation from fire hydrant and property lines

      • Location is proposed water and sewer services

      • Dimensions and height of all structures and % of lot coverage

      • Location of retaining walls

      • Location of any watercourses, drainage, ditches, culverts and other waterbodies including high water mark, top of bank and 1:100 year floodline contour (if available) with wave uprush limit.

      • Address and street name

      • Sight triangle (applicable on corner lots)

  • Health Unit approval (for rural areas); 613-354-3357

  • Cataraqui Region Conservation Authority approval (properties along or near water); 613-546-4228

  • Ministry of Transportation approval (properties that face provincial highways)

  • Entrance permit from the Loyalist Township engineering department, or the County of Lennox and Addington (properties that face county roads); 613-354-4883

  • Grading plan in combination with the plot plan, showing the final:New Home Warranty Form to be filled out

    • Entrance/driveway gradient
    • Lots grades as shown on the approved lot grading plan and all proposed building apron elevations (at each corner of the foundation wall), all swales and gradients (including intermediate elevations and drainage arrows indicating the direction of surface runoff, walkout elevations)
    • Building grade elevations (all elevations to be geodetic datum)
    • Finished floor elevation
    • Underside of footings elevation
    • Top of foundation wall elevation
    • Finished garage floor elevation
  • Heat Loss calculations and duct design

  • Completed “Statement Regarding Required Inspections” form

  • Engineered details must be certified/stamped by a Professional Engineer (must be licensed in Ontario)

  • If the house is not designed by the homeowner, completion of Form 1 by a registered qualified designer (unless prepared by a licensed Professional Engineer or Architect)

  • Energy Efficiency Design Sheet completed and signed

How much will it cost?

There are a number of fees and deposits that go into making up the cost of a building permit for a new home. To estimate the permit portion of the fee, please visit the fees section.

Rural dwellings

The Potable (drinkable) Water Policy is to ensure that the water distribution system in a building shall convey potable water as required by the Ontario Building Code.

This policy applies to buildings with potable plumbing that do not use a municipal water system as their source of water. Most often that means that your home is served by a private well for drinking water. 

If the potable water policy applies to your property, before a final inspection/occupancy will be granted, proof of potable water will be required.

On-Site Sewage 

On-Site Sewage Systems are enforced by Loyalist Township with the authority granted by the Ontario Building Code Act.

It is recommended that the applicant refer to the Ontario Building Code for the current construction requirements. It will be necessary, at minimum, to reference Part 8 of the Ontario Building Code to complete all calculations required to design a sewage system, you may also reference the Application Guide outlined below to assist in understanding the design requirements.

Application Guide

The application guide is provided to assist you when submitting a building permit application to Loyalist Township. The best way to expedite your application is to provide accurate and complete information. Incomplete or inaccurate information may result in your application not being accepted or returned to you to make corrections prior to processing.

 Class 2 sewage systems require a permit application

Class 3,4,5 Application for On-site Sewage 

 Class 3,4 & 5 On- Site Sewage System require a building permit application

Sewage System File Review - Renovations and Additions

To ensure that the application can be processed without delays, the applicant must confirm that the application is complete, with all information requested and forms completed to a level of detail that does not leave any uncertainty.

 Public Complaint Form

Any public concerns regarding sewage systems should be submitted via a public complaint form.

File Search

For information regarding existing sewage systems, please fill out the application and return to the building department with payment. Please note that a file search can take up to 14 business days granted there is sufficient information provided. 

Pool or Hot Tub

A building permit is required when you are installing a hot tub, a whirlpool or spa. You also need a permit if you are installing a pool, including inflatables, that can hold 24 inches or water or more. These all need to be protected by a fence or similar enclosure.

A fence isn't needed for a hot tub, whirlpool or spa if it is fitted with a lid or cover that locks. The lid must comply with clauses 9.1 and 9.2 and 9.4 of the American Society for Testing Materials (ASTM) Standard F1346.

What do I need to apply?

We have prepared a pools/hot tubs permit package for you to download to assist you in your application.In order for our building division to process your application for a deck permit, there are two drawings you must provide:

  • A site plan showing location of the deck and distances to lot lines and if applicable distance to the house

  • A plan for your deck

The following information is required for a pool/hot tub permit:

  • Completed Application form

  • Copy of deed

  • May require a grading plan (check with Building Department)

  • Plot/site plan showing:Approval from Electrical Safety Authority for circulation pump or overhead wires

    • Location of overhead wires
    • Pool/hot tub location relative to septic field/septic tank and well and distances to proposed pool (rural locations only)
    • Proximity of pool/hot tub to house and other structures
    • Proximity of pool/hot tub to property lines
    • Location and dimensions of registered easements and rights-of-way
    • Location and type of fence and/or enclosure
  • If deck is to be built in conjunction with the pool, cross section showing materials and spans.

  • Final grade elevation relative to top of pool for entire pool circumference (above ground pools only)

A Township Entrance Permit form shall be completed showing the intended access from the road to the pool installation area. A $100 application fee and $50 inspection fee is collected, and if access occurs over Township boulevards, sidewalks or curbs, a $2,500 damage deposit will also be collected. The damage deposit fee will be released at the completion of the project if there has been no damage done to Township property.

Visit our fees section for fee schedules. Construction costs for pools and hot tubs are based on the purchase and installation estimate provided by your contractor.

Woodstove

The installation of a woodstove, fireplace, chimney or outdoor solid fuel combustion appliance requires a building permit. Submitting a complete application will ensure the timely approval of your permit. Please note that most insurance companies will require a WETT certificate. Before starting the installation, you should notify your insurance company of your intentions.

A building permit is required for the installation/replacement of a:

  • Fireplace (masonry, insert, pre-manufactured)

  • Woodstove

  • Pellet stove

  • Chimney of any type

  • Outdoor wood furnace. Please note we have a by-law that regulates the use of outdoor wood furnace 2012-101)

How much will it cost?

Permit fees

Building permit fees are established in the Building By-law 2022-054. In 2022, permit fees are calculated as follows:

  • $16.92 per $1,000 of construction value for the first $1,000,000 in construction value
  • 40% of yearly calculated rate per $1,000 of construction value for amounts between $1,000,000 and $6,000,000
  • 25% of yearly calculated rate per $1,000 of construction value for amounts greater than $6,000,000
  • $10.00 per plumbing fixture, with a minimum charge for plumbing of $100.00
  • Minimum fee for all permits is $100.00

We calculate construction value as follows:

  • Residential dwelling - $145.00 per square foot, gross floor area
  • Garage - $50.00 per square foot, gross floor area
  • Shed - $50.00 per square foot, gross floor area
  • Deck, uncovered - $30.00 per square foot, gross deck area
  • Deck, covered - $45 per square foot, gross deck area
  • Basement renovation - $40.00 per square foot, renovation area
  • Farm buildings - $20.00 per square foot, gross floor area
  • Farm building, fabric covered structure - $15 per square foot, gross floor area

Development charges

Development charges are imposed on new developments to fund new infrastructure arising from growth. These charges are regulated under By-law 2021-066.

Works/impost (connection) fees

Works charges, commonly known as impost fees, are charged on new connections to fund new capacity for water and sewage treatment and pumping stations.

Other fees and deposits

Depending on the type of project, additional fees may be charged for associated permits, as well as damage deposits that may be refunded after the projected is done. If you have questions about fees, call us before you apply.

By-law 2022-054, the Building By-law, establishes the rules for construction, demolition, and change of use permits. Building permit fees are charged to help pay for the review of the proposed building and inspection of the project. The Building By-law does the following:

  • Establishes the classification of permit
  • Establishes various fees pertaining to construction, demolition, and change of use permits
  • Establishes types of notices and inspection required
  • Itemizes what information must be submitted with a building permit application
  • Rules and procedures for processing applications, including incomplete applications
  • Rules pertaining to the refund of fees
